Terms and Conditions - Seller Agreement (Seller) for HMS Boutique

This Product Listing Agreement (the "Agreement") sets forth the terms and conditions for sellers listing their products on the HMS Boutique platform. By listing your products on our platform, you agree to comply with these terms and conditions.

Product Listing:

By listing your products on HMS Boutique, you represent and warrant that you have legal ownership or authorization to sell the products offered. You agree to provide accurate and complete information about your products, including descriptions, pricing, availability, and any additional terms or conditions. Seller Responsibilities:

You are responsible for accurately representing and describing your products, including their features, specifications, and any limitations or restrictions. You will promptly respond to inquiries, provide updates, and communicate with users in a timely and professional manner. Pricing and Payments:

You have the discretion to set the pricing for your products. It is your responsibility to ensure that your prices are accurate and competitive. HMS Boutique will facilitate the payment process between you and users, deducting applicable fees as outlined in our separate fee structure. Product Delivery and Fulfillment:

It is your responsibility to ensure that your products are properly packaged and delivered to users in a satisfactory condition. User Satisfaction and Disputes:

You agree to make good faith efforts to resolve any disputes or issues that may arise between you and users regarding your products. In case of a dispute, HMS Boutique may, at its discretion, mediate or assist in resolving the issue but is not responsible for the outcome or resolution. Intellectual Property:

You retain ownership of any intellectual property rights associated with your products unless otherwise agreed upon with the user. Users may only use your products for their intended purpose and may not reproduce, distribute, or modify your products without your permission. Termination:

You may terminate this Agreement by removing your product listings from the HMS Boutique platform. HMS Boutique reserves the right to suspend or terminate your account and product listings if you violate these terms and conditions or engage in fraudulent or illegal activities. Modification of Terms:

HMS Boutique reserves the right to modify or update these terms and conditions at any time. Changes will be effective upon posting on our platform. It is your responsibility to review these terms periodically. By continuing to list your products on HMS Boutique, you accept any modified terms.

Monetary fine for delays by the merchant.
Profit margin of 17% quarterly on sales.
Taxes are deducted from the merchant.
Exchange policy only applies if there is a defect in the item (with the merchant covering delivery costs). Requests must be submitted within 12 hours of receipt.
We do not accept counterfeit brands.
